Terms and Conditions

The agreement between you and Smart Edu Hub covering how the platform, the mobile applications and the content within them may be used.

These Terms and Conditions ("Terms") form a legally binding agreement between Smart Edu Hub ("Smart Edu Hub", "SMeH", "we", "our", "us") and any natural person or legal entity ("User", "you", "your") who accesses, registers for, or otherwise uses our website, mobile applications, or related services (together, the "Services").

By creating an account, signing in, or otherwise using the Services, you confirm that you have read, understood and agreed to be bound by these Terms. If you do not agree, you must not use the Services.

In short

Use the Services lawfully and only for education. Keep your login details safe. Do not redistribute our content or content licensed to us. Only upload material you have the right to upload. Treat AI answers as a study aid, not as a final authority. Schools remain responsible for the student data they place on the platform.

1.Who we are

Smart Edu Hub is an education technology platform powered by Accessible Publishers Limited. It provides school management and academic administration tools for educational institutions, and learning and examination-preparation resources for individual learners.

These Terms apply to every part of the Services, including our website, the Smart Edu Hub mobile applications for iOS and Android, and any associated features, content and support.

2.Eligibility

  • The Services are intended for schools and educational institutions, their staff and students, guardians, and individual learners, in each case acting in compliance with applicable law.
  • You must be at least thirteen (13) years old to create an account directly. Learners under thirteen (13) may use the Services only through an account provisioned by their school, or with the consent and supervision of a parent or legal guardian.
  • If you register on behalf of a school or organisation, you represent that you are authorised to bind that organisation to these Terms.
  • You represent and warrant that you have the legal capacity to enter into this agreement.

3.Account types and registration

The Services support two distinct kinds of account.

  • School-provisioned accounts. Created and administered by a school for its administrators, teachers, students and guardians. The school controls these accounts, including the data held in them and their deactivation. If you hold such an account, your school's own policies apply to you in addition to these Terms.
  • Individual accounts. Created by a learner directly through the Smart Edu Hub mobile application, without a school. Registration is free of charge and requires email verification. The account holder is responsible for the account.

Individual and guardian sign-in is through the mobile app

Individual learner and guardian accounts are designed for the mobile experience and sign in through the Smart Edu Hub app rather than the web dashboard. Attempting to sign in on the website will direct you to download the app. This is a product design decision, not a fault.

  • You must provide accurate, current and complete information when registering, and keep it up to date. Inaccurate information may result in suspension or termination.
  • You are responsible for keeping your credentials confidential and for all activity carried out under your account. Do not share your login details.
  • You must notify us promptly at support@smart-edu-hub.com if you become aware of any unauthorised access to or use of your account.
  • Accounts are personal to the account holder and may not be sold, transferred or shared, except that schools may reassign school-provisioned accounts among their own staff and students.

4.Scope of the Services

Depending on your account type, subscription and the configuration chosen by your school, the Services may include:

  • For schools: management of students and teachers, classes and subjects, attendance, timetables, assessments and examinations, results, school communication, finance, academic records and digital learning resources, together with role-based access controls.
  • For learners: examination preparation using past questions from bodies including WAEC, JAMB, NECO, BECE and NCEE, digital learning materials, educational videos, interactive AI books, AI-assisted learning support, progress tracking and practice resources.

Availability of any particular feature depends on your account type, your subscription or entitlements, and, for school users, on what your school has enabled. We may add, change or remove features; where a change is material and adverse to paying users, we will give reasonable prior notice.

5.Acceptable use

You agree that you will not:

  • use the Services for any unlawful, fraudulent, defamatory or unauthorised purpose;
  • copy, download in bulk, scrape, republish, resell, sublicense or otherwise redistribute any content obtained through the Services, including past questions, digital books, videos and AI-generated explanations;
  • share your account, or provide access to paid content, with anyone who has not paid for it;
  • upload or transmit malicious code, or otherwise interfere with the operation, security or integrity of the Services;
  • attempt to gain unauthorised access to any part of the Services, another user's account, or any connected system;
  • reverse engineer, decompile or attempt to derive the source code of any part of the Services, except to the extent this restriction is prohibited by applicable law;
  • use automated means to access the Services in a way that places an unreasonable load on our infrastructure, or circumvent any usage limit, rate limit or entitlement check;
  • harass, abuse, threaten, impersonate or intimidate any other user, or upload content that is obscene, hateful or harmful to minors;
  • use the Services in breach of applicable education, child protection, examination or data protection law.

6.Academic integrity

The Services are built to help you learn and to help schools run fairly. You must not use them to gain an unfair academic advantage.

  • Do not use AI features, past questions or any other part of the Services to complete work that you are required to produce independently, where doing so would breach the rules of your school or examination body.
  • Do not share live assessment content, or use the Services to distribute answers during an examination or timed assessment.
  • School administrators and teachers are responsible for the integrity of assessments they create and administer through the platform.

The rules of your school and your examination body take precedence, and we will co-operate with lawful requests from them where misuse is alleged.

7.AI features and AI-generated output

Parts of the Services use artificial intelligence to explain concepts, answer questions about learning material, summarise documents and assist with content and administrative tasks. To provide these features we may transmit the relevant content of your request to third-party AI processing providers acting under contract to us.

AI output is a study aid, not an authority

AI systems can produce answers that are incomplete, outdated or simply wrong. You must not rely on AI-generated output as the sole basis for any academic, financial, disciplinary, medical, legal or administrative decision. Always verify against your textbook, your teacher, or the official source before acting on it.

  • We do not warrant that AI-generated output is accurate, complete, current or fit for any particular purpose.
  • AI features are subject to usage limits which may vary by plan, entitlement or free-tier configuration. We may apply fair-use limits to protect the Services for all users.
  • You must not use AI features to generate unlawful, abusive or infringing content, or to attempt to extract the underlying models, prompts or licensed source material.
  • Our handling of the data involved in these features is described in our Privacy Policy.

8.Your content and uploads

"Your Content" means anything you or your school submits to the Services — student records, lesson materials, assessments, messages, and any personal study material you upload, such as a PDF of your own notes.

  • You keep ownership. These Terms do not transfer any ownership of Your Content to us.
  • You grant us a limited licence. You grant Smart Edu Hub a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process and display Your Content solely to operate, secure and support the Services for you — including processing an uploaded document so that you can ask questions about it. This licence ends when the content is deleted, apart from copies retained in routine backups or as required by law.
  • You warrant that you have the right to upload it. You must own the material or have permission from the rights holder. Do not upload pirated textbooks, examination material you are not licensed to hold, or third-party content you have no right to reproduce. You are solely responsible for material you upload, and you indemnify us against claims arising from it.
  • Uploads may be limited or removed. Upload size, format, volume and retention limits apply and may change. We may remove content that breaches these Terms or that we are required to remove by law or by a rights holder, and may suspend accounts that repeatedly infringe.
  • Keep your own copy. The Services are not a backup service. Retain your own copies of anything you cannot afford to lose.

9.Our content and intellectual property

  • Smart Edu Hub and its licensors, including Accessible Publishers Limited, retain all intellectual property rights in the Services and in the content made available through them — software, designs, interfaces, trade marks, digital books, video lessons, question banks, and curated examination material.
  • Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use that content for your own learning or for the internal educational purposes of your school. This licence is for personal and institutional educational use only, and expressly excludes commercial exploitation, resale, public redistribution and the creation of derivative products.
  • Examination names and marks such as WAEC, JAMB, NECO, BECE and NCEE belong to their respective bodies. Their use on the platform is descriptive — to identify the examination that material relates to — and does not imply endorsement of, affiliation with, or approval by those bodies unless expressly stated.
  • If you believe content on the Services infringes your rights, contact us at support@smart-edu-hub.com with details sufficient to identify the material and your rights in it, and we will investigate and act where appropriate.

10.Competitions and academic programmes

We may run competitions, challenges and academic programmes through the Services, for schools and for individual learners.

  • Each competition may have its own published rules covering eligibility, entry deadlines, scoring, prizes and disqualification. Those rules apply in addition to these Terms and prevail over them in the event of conflict, to the extent of that conflict.
  • Entries must be the entrant's own work. Cheating, impersonation, multiple accounts and any manipulation of scoring will result in disqualification and may result in account termination.
  • Where results, leaderboards, certificates or participant names are published as part of a competition, entrants and, where relevant, their schools consent to that publication as described in the competition rules.
  • Prizes are as described in the applicable rules, are not transferable and, unless expressly stated, are not exchangeable for cash.

11.Partners and referral codes

  • We operate a partner programme under which approved partners may introduce schools or learners to the Services using a referral code.
  • If you enter a referral code at registration, we record it and may attribute your registration to the associated partner for the purpose of administering the programme.
  • Partners are independent of Smart Edu Hub. They are not authorised to make representations, promises or commitments on our behalf, and we are not bound by any statement a partner makes that is inconsistent with these Terms or our published materials.
  • Partner participation is governed by a separate partner agreement. We may withhold commission and terminate participation where a referral is fraudulent, incentivised improperly, or otherwise in breach of that agreement.

12.Subscriptions, payments and refunds

  • Creating an Individual account is free. Certain content, features and usage allowances are paid, and any free-access tier we offer may be time-limited or subject to usage caps, which we may change.
  • School subscriptions are priced according to the agreement reached with the school. Fees are payable in advance for the agreed billing period unless otherwise agreed in writing.
  • All fees are exclusive of applicable taxes, levies and duties, which are payable by you.
  • Payments are processed by third-party payment providers. We do not store your full card details. Where you authorise a recurring payment, you authorise us and our payment provider to charge the saved payment method for each renewal until you cancel.
  • You may cancel a renewing subscription at any time before the next renewal date. Cancellation stops future charges; access continues to the end of the period already paid for.
  • Late or failed payment may result in suspension or downgrade of paid features after reasonable notice.
  • We may change pricing on at least thirty (30) days' notice to existing subscribers. Changes take effect from the next renewal.
  • Refunds. Digital content and entitlements are delivered immediately and are generally non-refundable once accessed, except where a refund is required by applicable consumer law or where we have failed to deliver what you paid for. Where a purchase was made through the Apple App Store or Google Play, that store's refund process applies. To raise a billing issue, contact support@smart-edu-hub.com.
  • Where the Services provide credits or a wallet balance, credits are a prepaid entitlement to use specific features. They have no cash value, are not transferable, and are not redeemable for cash except where required by law.

13.Mobile applications and app stores

  • The Smart Edu Hub mobile applications are distributed through the Apple App Store and Google Play. Your use of each application is also subject to that store's own terms of service.
  • Apple and Google are not parties to these Terms, are not responsible for the Services or their content, and have no obligation to provide support or maintenance for the applications. Any claim relating to the applications is between you and Smart Edu Hub.
  • Where you make a purchase through an app store, that store handles the payment and its billing, cancellation and refund rules apply.
  • You are responsible for your own device, operating system updates and data charges. We support current versions of the applications; older versions may stop working over time.

14.Availability and changes to the Services

  • We aim to keep the Services available and reliable, but we do not guarantee uninterrupted access. Planned maintenance, updates and factors outside our control may cause downtime.
  • We may modify, suspend or discontinue any part of the Services. Where a discontinuation materially affects a paid subscription, we will give reasonable notice and, where appropriate, a pro-rata refund for the unused period.
  • The Services may link to or rely on third-party services. We are not responsible for the content, availability or practices of third parties.

15.Warranty disclaimer and limitation of liability

  • The Services are provided on an "as is" and "as available" basis, without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
  • We do not warrant that the Services will meet your requirements, that they will be uninterrupted or error-free, that defects will be corrected, or that any particular academic or examination outcome will be achieved.
  • To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or anticipated savings, arising out of or in connection with the Services.
  • To the fullest extent permitted by law, our aggregate liability arising out of or relating to these Terms shall not exceed the greater of (a) the total fees you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred thousand naira (₦100,000).
  • Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.
  • We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, industrial action, power failure, or telecommunications and internet outages.

16.Data protection and privacy

  • Personal data is collected, processed and stored in accordance with our Privacy Policy and applicable data protection law, including the Nigeria Data Protection Act and, where relevant, other national data protection legislation.
  • Where a school places student data on the platform, the school acts as data controller and Smart Edu Hub acts as processor on its behalf. The school warrants that it has obtained all necessary parental or guardian consents and has the lawful basis required to provide that data to us.
  • Individual account holders are the data subjects for their own accounts and may exercise their rights, including deletion, as set out in the Privacy Policy.
  • Our use of cookies and similar technologies is described in our Cookies Policy.

17.Suspension and termination

  • You may stop using the Services at any time. Individual account holders may request account deletion as described in the Privacy Policy. School users should contact their school administrator.
  • We may suspend or terminate access immediately where there is a material breach of these Terms, non-payment, suspected fraud or unauthorised access, a risk to other users or to the security of the Services, or where required by law.
  • Where circumstances reasonably permit, we will give notice and an opportunity to remedy a breach before terminating.
  • On termination, your right to access the Services ends. We will make reasonable efforts to allow a school to export its data for thirty (30) days following termination, subject to technical feasibility and settlement of outstanding fees.
  • Provisions which by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnity and governing law — continue to apply.

18.Indemnification

You agree to indemnify, defend and hold harmless Smart Edu Hub, Accessible Publishers Limited, and their officers, directors, employees, agents and affiliates from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or relating to your use of the Services, content you upload, your breach of these Terms, or your infringement of any third-party right.

19.Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules, and without prejudice to any mandatory consumer protections available to you under the law of your country of residence.

The parties will attempt in good faith to resolve any dispute informally by contacting support@smart-edu-hub.com before commencing proceedings. Any dispute that cannot be resolved informally is subject to the exclusive jurisdiction of the competent courts of Nigeria, unless otherwise agreed in writing.

20.Amendments to these Terms

  • We may amend these Terms to reflect changes to the Services, the law, or our business practices.
  • Notice of material changes will be given by email to your registered address or through an in-platform notification, and the "last updated" date at the top of this page will change.
  • Continued use of the Services after a change takes effect constitutes acceptance of the amended Terms. If you do not agree, you must stop using the Services and may cancel your subscription.

21.General provisions

  • Severability. If any provision is held invalid or unenforceable, it shall be modified to the minimum extent necessary to be enforceable or, failing that, severed. The remaining provisions continue in full force.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign your rights under these Terms without our written consent. We may assign them as part of a merger, acquisition or sale of assets, on notice to you.
  • Entire agreement. These Terms, together with the Privacy Policy, the Cookies Policy and any subscription or competition terms we agree with you, form the entire agreement between us regarding the Services.
